Hajj scandal case: DG FIA messing Up

Latest News Islamabad—Chief Justice Iftikhar Mohammad Chaudhry on Thursday observed that efforts had been made to save the big people involved in Haj corruption scandal.

Hajj scandal caseHe said people responsible for the mess will be identified at any cost. The chief justice further remarked that the DG FIA Wasim Ahmed has messed up the case, therefore, the court will take action against him first.

The Chief Justice of Pakistan made these remarks during the hearing of the Haj scandal suu moto case. A seven member Supreme Court bench headed by the chief justice and comprising Justice Javed Iqbal, Justice Tassaduq Hussain Jillani, Justice Raja Fayyaz, Justice Anwar Zaheer Jamali , Justice Ghulam Rabbani and Justice Khalilur Rehman Ramday is hearing the case.

At the start of the hearing, the Supreme Court expressed dissatisfaction over the FIA for not completing the investigation of Haj scandal case and also questioned the sphere of powers of the newly appointed investigation officer.

The chief justice said the court wants that all the affairs should run smoothly. Attorney General Maulvi Anwarul Haq told the court that the government has appointed a new investigation officer, who will take directions from the apex court directly.

Justice Iftikhar Chaudhry remarked that the loss of Rs400 million would be recovered form the responsible persons.

FIA’ Legal Director Azam Khan said a person named Musharraf Haider received Rs2.6 million from Rao Shakeel. He said he got this money for construction of a marriage hall building. Justice Raja Fayyaz said all the concerned accounts should be frozen. He expressed dissatisfaction over the FIA’s report. The chief justice also remarked that the report is only meant to waste time and no meaningful progress has been made.

Justice Ramday said the statement of Zarin Sukhera was taken nine days ago but no action has been taken against him so far. He said all persons found involved in messing up the case should be dismissed. “We will not sit back as silent spectators or puppets and will take strict action,” he said.

Justice Jamali remarked that if the person who messed up the case is the boss, then how the organisation will work.

The chief justice said the notification is only about overseeing the investigation which has no place in FIA Act 1974. He said the FIA boss is only a contract employee and he is not even a civil servant. He said a person who is not a civil servant is not answerable under any code of conduct and undue delay often proves fatal in a criminal case.

The court was told that Javed Bukhari was appointed Additional DG FIA. Javed Bukhari told the court that he could not conduct independent investigations under the DG. However, Chief Justice told him that he would work under the DG FIA. He said the Establishment Division has appointed the investigation officer without reading the law.

Justice Jamali said despite strict observation of the court the DG FIA has still not been removed. He said the government seems powerless to remove this person.

Chief Justice Iftikhar Chaudhry said Secretary Establishment should be given a notice as to how he has appointed a contract employee as the head of such an organised force.

Justice Ramday said the gas company head is also a contract employee, that is why gas is not available to any one.

Secretary Religious Affairs told the court that the process of payment of compensation has been initiated and 90 percent task will be completed by January 25.
